Notional Covenants and Restrictions
For Notional Deeds for Notional One (1) Square Foot Lots
WHEREAS Sunbury Shores Arts and Nature Centre, Incorporated, a New Brunswick nonprofit corporation, is the owner of all the land as described on this website, and is desirous of notionally subdividing these parcels into notional one (1) square foot lots and making "Deeds" available to its supporters, for individual notional one (1) square foot lots;
WHEREAS Sunbury Shores Arts and Nature Centre, Incorporated has not applied for and does not qualify for any legal subdivision of these lands into the above described "notional lots" and therefore these Deeds will be issued as a NOVELTY for the supporters of Sunbury Shores Arts and Nature Centre, Incorporated, not as an investment for the purchaser.
NOW THEREFORE Sunbury Shores Arts and Nature Centre, Incorporated, establishes the following notional covenants, restrictions, limitations, and reservations upon each of the parcels and on the notional ownership, use and occupancy there of:
The owner may pretend or make pretences of ownership.
The owner may not make any improvements to or develop the parcels.
The owner may not occupy the parcels but may attempt to visually identify the lot to friends so long as they travel to and from the lot while making their best attempts to perform a "silly walk" as demonstrated by members of the Monty Python comedy troupe.
The owner grants rights of ingress and egress over the lot for all others. At the very least, they agree to roll-over out of the way if they should be trying to be in contact with their parcel when someone else is trying to travel over the lot.
The notional Deeds have no value. Under extreme circumstances they could be sold for notional money that may only be spent in notional stores or deposited into notional banks. They cannot be traded for "notions" at fabric stores. The profit associated with ownership is restricted to feeling very good about oneself and Sunbury Shores.
Sunbury Shores Arts and Nature Centre, Incorporated will continue to be the real owner of the property and will be responsible for all real estate taxes on the property and for complying with any and all local regulations.
The number of Deeds issued by Sunbury Shores Arts and Nature Centre, Incorporated will not exceed the number of square feet in the property unless notional condominiums are imagined.
Since the Deed is notional and not real consideration for the purchase price of the notional lot, charitable receipts may be given.
Sunbury Shores Arts and Nature Centre, Incorporated intends to own these properties indefinitely into the future and to use the lands in its best interests and in the best interests of its membership.
Needless to say these "mini-estates" cannot be built on, lived on or retired on unless you are so small that we cannot see you. Owners shall not occupy the parcels except while randomly walking around or over the property while using one or both feet at the same time. "One Foot or Two Feet at a Time" walkers and/or owners are completely free of additional responsibility and obligation.
Owners also will not have to pay real property taxes of any kind ...ever, and will not be required to mow, pick up trash (except their own), or comply with any local, regulations.
The lawyer says we have to say again "These mini-parcels are not intended for investment purposes, are for novelty purposes only, and cannot be sold by owners for profit".
